Are there any legal issues with taping a conversation with only some parties being aware of said taping?

I've always been under the impression that recording a meeting (even covertly) for personal use and using it for your own personal affairs is exempt from any legal constraints. That's what Carlton has done here. Some media people already saying - 'I can't believe they didn't hand it over'...well - they might have been in trouble if they did. I'm sure (I sure hope) the club would have checked its legal position before the recording took place.

Its not illegal to record a conversation to which you are a direct party, provided the recording is for private use and is not played to any other person that wasn't a party to the conversation. There is subsequently nothing illegal if you are forced to comply with a lawful directive (by a court of law) to hand over the recording to a lawful body.

Typical opposition supporters, anything to throw Carlton into the fire 1st & foremost!
The very reason I couldn't give a flying f*** about any other scum bag of a team that goes down and out.

Correct. Problem is if we were to disclose it without a legal request from the AFL or other party, then it would a breach on our behalf. But were does it say we have not "mentioned" the recording to the spew?

and you wouldnt expect otherwise from Carlton. given that neither the AFL or ASADA are judicial bodies with the authority to compel the handover of private material that would result in breaking the law. if those requests were accompanied by an official court order then the club would handover the recording. We don't brake the law, we aren't cheats, we are reformed :smoking:

Tommy Stringer Bell has been careful to not speak with Justin Recordy.

This thread is scandalous and offensive to James Hird.
He is a top bloke and an asset to the game and he would NEVER let this happen on his watch.

Everyone involved must be lying and the recording must have been faked.

The Bombers are very brave to withstand this conspiracy against them.

I think they should get new supporter signs printed for their game this weekend.

The truth is on their side!!!!!!!!!!!!!

If it is eventualy found that they breached the rules on this issue (and thankfully the investigation is being driven by a body other than the AFL, so unlikey to be any sweeping of the evidence under the carpet) then its fair to expect they receive a sufficiently applicable whack"""" .

Glad we were proactive in finding out what they we're doing and not stupid enough to follow them down that path despite the potential advantages. Who knows what old Carlton would've done if faced with a similar situation.

Anyone know much about our supplement program and what processes we have in place to make sure we know exactly what players are taking?
