Quote:
AFL football operations manager Adrian Anderson last night confirmed to the Herald Sun that Judd's deal with Visy could no longer be excluded from the salary cap.

"It is not appropriate to release my specific reasons for exercising my discretion in this case to refuse approval for the arrangements to be excluded from Carlton's salary cap," Anderson said.

"My decision is related to a tightening of the rules."
It emerged last night that Adelaide captain Nathan van Berlo was under investigation for third-party payments outside the salary cap.

Just further illustrates the @#$%&! amateurism of this organisation that calls itself the Australian Football League.

Its these knee jerk reactions that make our sport a laughing stock around the world.

The AFL needs to be seriously careful with what they're doing at the moment. This, along with the Tippett saga... They seem to think they are bigger than the law

Geez the AFL act swiftly when it comes to matters relating to Carlton. Other teams, they have all the time in the world to conclude their investigations.

Unbelievable, how can they pull the plug on something they have already signed off. When the contract ends, for sure, but not in the middle of a contract ?

Mark Stevens has a crack at the AFL any time he can yet shows no moral outrage about the fact that are 115 of these deals, and the goal posts have been changed mid contract.

Much more concerning issues, like the fact that WB have no Friday night games in 2013....

I hope Juddy offers to forfeit the extra payments if they can't overturn the decision. He's obviously made a truck load of money off the club I the last 5 years and would like to think he'll put the chance at a flag above a bit of extra cash.

On another thought, what's to stop visy employing Judd when he retires from footy and paying him as much as they like?

So does that mean they will be cancelling Abletts third party deals. Only a month ago it was mentioned that Cloke would be getting lucrative opportunities outside of footy....

Of course not, only Carlton cheats, tanks and has players on 3rd party deals.

Once again the AFL make up policy on the run and bow to public and media pressure.

Amazing that Eddie McGuire can whinge about Judd's deal with a straight face yet Travis Cloke is reported to be getting "opportunities after football" as a sweetener to stay at Collingwood.

The AFL changed the qualification criteria for priority picks mid- stream in 2006 which rogered us right royally - why should unilaterally changing the terms of a contract when it had 1 year to run cause the flowering dimwits at the AFL any concern.

How can you have a "crackdown" on something that's approved?

I would have thought a phrase like "shifting the goal posts" was more fitting.

Or just "we changed our minds".

What are these WB's you speak of?

Can't see how the AFL can legally change rules they signed off on originally. I know, the AFL can do what ever they like. I think we may have a case this time. This agreement should be allowed until the end of Judd's contract. Whether it was right for it to be allowed in the first place is not the issue. Should not be able to do retrospective. Interesting to read Anderson used his own discretion regarding this. About time Carlton stood up again instead of rolling over.

There was a time in the early 1980's when Jack Hamilton went cap in hand to the Federal Government asking that the VFL be exempt from relevant clauses in the Trade Practices Act - (as a result of Foschini/Morwood Case) - and of course rightfully was laughed out of Canberra.

How the wheel has turned, the AFL can now just ignore about 1000 years of Common & Contract law.

No wonder that snivelling little pissant left the anonymous world of Corporate Law.

For what it is worth Greg Denham on SEN stated that the original VISY deal was a 3 year contract running from 2008 to 2011, this agreement was extended for a further year until 2012. This banning of the VISY deal is related to the AFL not permitting Paul Connor's application for a new 2 year extension of the arrangement. He also said that the application has been with the AFL for a number of months and that the club/Connor's were only informed on Oct 22 that the new application was declined - raising questions about the timing of the ruling considering the Tippett saga.

So in effect the AFL aren't breaking any contracts, they just aren't approving contracts/arrangements which they have done previously.

Well someone's maths are a little out because a 3 year contract from 2008 runs to 2010.

Thanks for that info Ciccio. That puts that to bed now. Lets hope it's a level playing field and they scrutinise other clubs like they seem to do with us.

When it comes to the AFL it's anything but a level playing field where all clubs are treated equally....
